How Does the Mississippi Circuit Court Work?

The Circuit Courts in Mississippi have original jurisdiction over all civil actions where the principal amount in dispute is above $200, and over all matters arising under the Constitution and laws of the state of Mississippi that are outside the exclusive jurisdiction of another court. Circuit Courts also have original jurisdiction over all criminal matters that do not fall withinother courts’the exclusive jurisdiction. Mississippi Circuit Courts exercise jurisdiction over felony matters.

Circuit Courts are authorized to hear appeals from County, Justice, and Municipal Courts. The Circuit Courts hear appeals from the administrative boards and commissions such as the Mississippi Workers’ Compensation Commission and the Mississippi Department of Employment Security.

Mississippi is divided into 22 Circuit Court districts:

  • District 1 - Alcorn, Itawamba, Lee, Monroe, Pontotoc, Prentiss, and Tishomingo Counties
  • District 2 - Hancock, Harrison, and Stone Counties
  • District 3 -Benton, Calhoun, Chickasaw, Lafayette, Marshall, Tippah, and Union Counties
  • District 4 - Leflore, Sunflower, and Washington Counties
  • District 5 - Attala, Carroll, Choctaw, Grenada, Montgomery, Webster, and Winston Counties
  • District 6 - Adams, Amite, Franklin, and Wilkinson Counties
  • District 7 - Hinds County
  • District 8 - Leake, Neshoba, Newton, and Scott Counties
  • District 9 - Issaquena, Sharkey, and Warren Counties

There are 57 Circuit Court judges in Mississippi. The number of judges per Circuit Court district varies between one to four. Trials in the court are heard with a 12-member jury and usually one or two alternate jurors. However, a judge may preside without a jury in cases pertaining to a question of law rather than fact. Judges are elected to four-year terms in non-partisan elections. To serve as a Circuit Court judge, a candidate must have been a citizen of Mississippi for at least five years, be a practicing lawyer for five years, 26 years of age or older, and a citizen of the district of service. Vacancies in the Circuit Courts are filled by appointment made the Governor. Instead of serving out the predecessor’s term, an interim appointee must run for re-election in the next general election, usually nine months or more after the appointment.

Circuit Court judges may be removed:

  • By the Governor upon the joint address of two-thirds of both houses of the Mississippi legislature
  • By impeachment on the votes of two-thirds of the house of representatives, and two-thirds removal vote by the senate
  • By a recommendation of the Judicial Performance Commission

Interested persons may view court records for Mississippi Circuit Courts that participate in the Mississippi Electronic Courts (MEC) project through its Public Access Mississippi Electronic Case Management system, PAMEC. PAMEC allows the public to view case information for most of the courts in the state

To view case information for cases in the trial courts, a PAMEC account will be required. A PAMEC login can be acquired from the PAMEC registration page. The platform requires a $10 annual subscription fee. Users may select “Pay Online” to pay the annual fee by debit/credit card or electronic check, which will allow same-day access to the MEC system. Users who select “Mail a Physical Check” will have their access to the system delayed until the check is received and processed.
