How Does the Mississippi Justice Court Work?

Mississippi Justice Courts have jurisdiction over small claim cases in which the amount in dispute does not exceed $3,500, misdemeanor criminal cases, and any traffic offense that occurs outside a municipality. Justice Court judges are authorized to conduct bond hearings and preliminary hearings in felony criminal cases and may issue search warrants. Appeals of the decision of the Justice Court may be made to the Circuit Court or the County Court. Other matters that may be handled in the Justice Court include:

• Marriage Ceremonies
• Highway patrol, Sheriff Department, Constables and Mississippi Department of Transportation Citations
• Fish and Wildlife and Department of Marine Resources Citations

One hundred ninety-seven judges presently serve in the 82 Justice Courts in Mississippi. These judges are elected in partisan elections to serve four-year terms. To serve as a Justice Judge in Mississippi, the candidate must meet specific requirements:

• A qualified elector
• High School graduate or it’s equivalent
• A resident of the County for a minimum of two years prior the day of the election
• Completion of the Justice Court Training Course provided by the Mississippi Judicial College of the University of Mississippi Law Center within six months of assuming office
• Participation in an annual continuing education as prescribed by the Judicial College
• Hold a minimum of one session of court per month, but not more than two

Justice Court judges may be removed by a recommendation of the Judicial Performance Commission. Vacancies on the Justice courts are filled by the appointment of a person selected by the local board of supervisors. Besides the Justice Court judges, Constables also serve on the Justice Court by attending court proceedings, posting bonds, and executing judgment in any criminal case before the court. Constables serving in the Justice Courts are elected from their respective districts and usually serve county-wide jurisdiction.
