How Does the Mississippi Chancery Court Work?

Mississippi Chancery Courts are trial courts with jurisdiction over matters of equity such as:

• Domestic matters, including adoptions
• Custody disputes and divorces
• Guardianships
• Sanity hearings
• Wills
• Trusts
• Challenges to the constitutionality of state laws

Chancery Courts have jurisdiction over juvenile matters in counties that do not have County Courts. Judges in the Chancery Courts are usually referred to as chancellors. Chancellors may appoint a lawyer in private practice to sit as a youth court referee to arbitrate in juvenile matters such as abuse, delinquency, and neglect. A chancellor typically hears Chancery Court trials without a jury; however, Mississippi statutes allow the parties in a case to request a jury in the Chancery Court. Land records in the state are filed in the Chancery Courts.

There are 20 Chancery Court Districts in Mississippi. The number of chancery judges per district varies between one and four. Among other factors, the number of chancellors in a chancery district is determined by the population and number of cases filed in the district. Mississippi Chancery Districts and the counties served are listed below:

• 1st Chancery District - Alcorn, Tishomingo, Prentiss, Pontotoc, Lee, Itawamba, Monroe, and Union Counties
• 2nd Chancery District - Scott, Newton, and Jasper Counties
• 3rd Chancery District - DeSoto, Tate, Panola, Yalobusha, Grenada, and Montgomery Counties
• 4th Chancery District - Franklin, Amite, Pike, and Walthall Counties
• 5th Chancery District - Hinds County
• 6th Chancery District - Attala, Carroll, Choctaw, Kemper, Neshoba, and Winston Counties
• 7th Chancery District - Bolivar, Coahoma, LeFlore, Quitman, Tallahatchie, and Tunica Counties
• 8th Chancery District - Hancock, Harrison, and Stone Counties
• 9th Chancery District - Humphreys, Issaquena, Sharkey, Sunflower, Warren, and Washington Counties
• 10th Chancery District - Forrest, Lamar, Marion, Pearl River, and Perry Counties
• 11th Chancery District - Holmes, Leake, Madison, and Yazoo Counties
• 12th Chancery District - Clarke and Lauderdale Counties
• 13th Chancery District - Covington, Jefferson Davis, Lawrence, Simpson, and Smith Counties

53 Chancery Court judges serve in the 20 Chancery Court Districts. The judges are each elected to four-year terms in non-partisan elections. To be eligible to serve as a Chancery Judge, an individual is required to:

• Be at least 26 years old
• Be a district resident for at least five years
• Be a resident of Mississippi for five years
• Have at least five years of experience as an attorney

Chancery Court judges may be removed:

• By the Governor upon the joint address of two-thirds of both houses of the Mississippi legislature.
• By impeachment on the votes of two-thirds of the house of representatives, and two-thirds removal vote by the senate
• By a recommendation of the Judicial Performance Commission

Interested persons may view court records for Mississippi Chancery Courts that participate in the Mississippi Electronic Courts (MEC) project through its Public Access Mississippi Electronic Case Management system, PAMEC. PAMEC allows the public to view case information for most of the courts in the state.

To view case information for cases in the trial courts, a PAMEC login will be required. A PAMEC login may be acquired from the PAMEC registration page. The platform requires a $10 annual subscription fee. Users may select “Pay Online” to pay the annual fee by debit/credit card or electronic check, which will allow same-day access to the MEC system. Users who select “Mail a Physical Check” will have their access to the system delayed until the check is received and processed.
