Monroe County Arrest Records

In Monroe County, an officer may arrest any individual for a criminal offense or breach of peace or an attempt to breach the peace when the individual commits the act in his presence or when a person has committed a felony (whether or not it occurred in the presence of the officer) and he has reasonable grounds to suspect and believe the person to be arrested committed the said felony. An officer may also arrest a suspect if an arrest warrant has been issued naming him as an offender (MS Code § 99-3-7).

An arrest warrant is an official document indicating that a law enforcement officer has apprehended, arrested, and taken into custody an offender or suspect. It contains details about the arrested person, the events surrounding the arrest, the charges, conditions for release, and the arresting officer and agency.

The Monroe County Sheriff’s Office generates arrest records for the county. These records are public and can be accessed through the Sheriff’s Office. Arrest information may also be indexed within Monroe County Court Records and criminal history records through the Mississippi Department of Public Safety’s Criminal Information Center (CIC).

Are Arrest Records Public in Monroe County?

Yes. Under the Mississippi Public Records Act of 1983, all records prepared, filed, and maintained by government bodies in connection with public matters are public records. They must be available for inspection and copying by any person. Each public body must make all public records in its custody reasonably accessible to members of the public.

Although Monroe County arrest records are public records, they may be exempt from public disclosure in situations the law deems necessary and where such disclosure would interfere with law enforcement investigations. Arrest records may also be limited from public disclosure where such disclosure would reveal the identity of informants or witnesses, deprive a person of the right to a fair trial and impartial adjudication, and endanger the life and safety of a public officer, law enforcement personnel, confidential informant, or witness.

What Do Public Arrest Records Contain?

Members of the public can expect to find the following information in a Monroe County public arrest record:

  • The identity of the arrested person: their full name, alias (if any), age, and date of birth.
  • Physical description of the arrestee: sex, race, height, and eye color.
  • Mugshot (photograph)
  • Arrest information: Arrest and booking time and date, arresting agency, arrest county, bail amount, place of incarceration, and release information.
  • Booking time, date, and ID
  • Case number
  • Charges: A brief description of the charges
  • Conditions for release
  • Holding facility
  • Case status.

Free Arrest Record Search in Monroe County

Alternatively, searchers may consider third-party public record search sites. How Long Do Arrests Stay on Your Record?

In Mississippi, arrest records stay on an individual's record indefinitely. However, after a specific period outlined by the Mississippi Code of Criminal Procedure has passed, a person may petition the court to have their arrest record and other related non-conviction criminal records expunged.

Expunge Monroe County Arrest Records

An individual may be eligible to petition the court to expunge records of their arrest if the offense is a misdemeanor or they were not formally charged or prosecuted within 12 months of the arrest, or the case was dismissed, and where the charges were dropped, the accused was acquitted, or order of Nolle Prosequi was issued, or the accused was not indicted, or the offender was sentenced to pretrial diversion or placed on non-adjudicated probation.

Per the Mississippi Code § 99-15-59, any person who was arrested for an offense constituting a misdemeanor and was not formally charged or convicted within 12 months from the date of the arrest or after being charged to have the charges dismissed may petition the court to expunge the record of arrest and other related records.

Where the justice or judge of the county, circuit, or municipal court finds that the petition meets the requirements of the law and that there are no objections, the judge or justice shall expunge the record of any case in which the arrest was made, the person arrested was released, and the case was dismissed, or the charges were dropped, or the record of any such case where there was no disposition (MS Code § 99-19-71 (2)).

Monroe County Arrest Warrants

An arrest warrant is a legal document issued by a judge that directs law enforcement officers to arrest a named individual when there is probable cause to believe that this person has committed a criminal offense (Miss. R. Crim. P. 3.1).

A Monroe County arrest warrant must include the defendant's full name. If the name is unknown, the warrant should contain any identifying name or description that allows the individual to be reasonably identified, as well as the defendant's location. Additionally, the warrant must specify the offense with which the defendant is charged and order the arrest of the defendant to bring them before the issuing judge or the nearest accessible judge with jurisdiction (Miss. R. Crim. P. 3.2).

Do Monroe County Arrest Warrants Expire?

No. Arrest warrants issued in Mississippi do not expire. It does not matter whether the chargeable offense is a felony or misdemeanor. However, a bench warrant issued for the arrest of a person for failure to show up in court may become invalid after a couple of years and will be recalled if and when the defendant presents himself before the court. It is advisable to consult an attorney to discuss how to resolve the warrant. A warrant issued in Monroe County may be executed anywhere in the state.
